DANVILLE —
The majority of the settlement in the Chris Gaston case will be split among his family members.
The city confirmed late last month that it had reached a settlement in the case regarding the death of Gaston in the stairwell of the Walnut Street parking garage on April 4, 2006. The family brought a wrongful death suit against the city as a result of the death the following year.
Court documents show the city settled with Gaston’s father, Charles Gaston Jr., for the amount of $700,000. Danville Mayor Scott Eisenhauer has said the settlement benefits outweighed the potential cost to the city if the case had proceeded to trial.
In the court order dismissing the case, more than half of the money — $400,000 — will be split equally among four of the deceased’s family members, his father, mother and two sisters. The remainder will cover expenses and attorneys fees for the lawyers representing the family in the case.
