URBANA —
A Vermilion County man was one of three defendants with child pornography indictments returned against them this week.
The U.S. District Court in Urbana announced the case Friday against Danny L. Smith of Georgetown, who appeared before U.S. Magistrate Judge Bernthal on Sept. 11. Bernthal ordered Smith detained in the custody of U.S. marshals.
An indictment charging Smith with three counts of distribution of child pornography and one count of possession of child pornography was returned late Thursday.
The three distribution counts allegedly took place between May and June. The possession charge stems from September.
Federal court documents contend Smith downloaded almost 100 suspected child pornography files in July. Federal agents confirmed Smith was in possession of a little more than 2,300 child porn images stored on a computer in his home at the time of his arrest.
If convicted, the statutory penalty for each count of distribution of child pornography is a mandatory minimum of five to 20 years in prison and a term of supervised release of up to life following any term of imprisonment.
If a defendant has a prior child sex abuse or child pornography conviction, the statutory penalty is not less than 15 to 40 years in prison. For possession of child pornography, the penalty is up to 10 years in prison.
Smith’s indictment seeks forfeiture of computers and related materials allegedly used to commit or promote the offenses.
The other defendants charged this week were from Champaign and Clinton and were charged in separate cases.
